Law no. 1.546 of 20 April 2023 amending articles 7 and 8 of the Code of Criminal Procedure
As a result of the Sovereign Cloud, the Principality will have the capacity to back up protected data in Luxembourg, guaranteeing the inviolability of sensitive data. (Law no. 1.545 of 20 April 2023 approving the ratification of the agreement between the Grand Duchy of Luxembourg and the Principality of Monaco concerning the hosting of data and information systems).
Following on from this, Law no. 1.546 of 20 April 2023 amends articles 7 and 8 of the Code of Criminal Procedure to extend the jurisdiction of the Monegasque courts to any cyber-attacks committed against data protected in premises made available to the State of Monaco under an international commitment, intended to host data, information systems and associated equipment, hardware, licences and components, such as electronic communications systems or storage solutions abroad.
As a result, Monegasque courts will have jurisdiction to investigate and try a foreign perpetrator who has committed an offence against Monegasque data located in a foreign country.
